How Virginia farm leases work
When a Virginia lease can end, how much notice it takes and what to put in writing.
How to end a Virginia farm lease
Virginia's nonresidential tenancy chapter expressly covers land rented for agricultural purposes. The lease controls; the statute fills in only where the lease is silent (Va. Code § 55.1-1400).
| Situation | Notice rule |
|---|---|
| Year-to-year tenancy | 3 months' written notice before the end of the lease year |
| Month-to-month tenancy | 30 days' written notice before the next rent due date |
| Lease with its own notice terms | Follow the lease |
| Any termination notice | A separate writing, not a clause in the lease |
Under § 55.1-1410, notice is given under the chapter or the lease, and it must be a separate document. For a lease year ending Dec 31, send it by Sept 30 and keep proof of delivery. Compare every state in Oaken's farm lease termination guide.

Setting the rent? The 2026 median non-irrigated cropland rent across 86 of 98 published Virginia counties and cities is $46.50 per acre. Compare yours on the Virginia cash rent by county map or read the 2026 rent negotiation guide.
Oral vs. written leases in Virginia
Under Virginia's statute of frauds, Va. Code § 11-2, a lease of real estate for more than a year must be in writing and signed. Hay ground, row-crop and pasture rentals all need clear written terms.
Our advice: a lease that has rolled over for years on a handshake leaves no record of the rent, input splits or notice terms. Write it down, even for a one-year deal. Get the templates →

Virginia farm lease questions
What is the deadline to terminate a farm lease in Virginia?
Under Va. Code § 55.1-1410, a year-to-year tenancy, including farmland, ends with 3 months' written notice before the end of the lease year, so by Sept 30 for a lease year ending Dec 31. A month-to-month tenancy takes 30 days' written notice before the next rent due date, unless the lease sets a different period.
Does Virginia's notice rule apply to farm leases?
Yes. Va. Code § 55.1-1400 defines a nonresidential tenancy to include real estate rented for agricultural purposes. The lease controls the relationship; the statute applies where the lease is silent. The notice must be a separate writing, not part of the lease.
Does a Virginia farm lease need to be in writing?
A lease of real estate for more than a year must be in writing and signed by the party to be charged, under Va. Code § 11-2. A one-year lease can be oral, but a written lease records the rent, term, crop share and notice rules.
What is the average farmland cash rent in Virginia in 2026?
Across the 86 of 98 Virginia counties and cities with published 2026 USDA NASS cash rent data, the median county rent for non-irrigated cropland is $46.50 per acre. Oaken's Virginia cash rent map shows every published county, its rank and its change from 2025.
How does Oaken help manage Virginia farmland leases?
Oaken keeps every Virginia lease, landowner and payment in one place. It tracks rent due dates and each lease's notice deadline, calculates flex and crop-share payments, and gives landowners a portal for statements, so nothing depends on a binder or one person's memory.
